85% Crimes Are Mostly a Violent Variety of Crimes
Video Transcribed: What is an 85% crime in the state of Oklahoma? I am Stuart Erickson, Wagoner attorney.85% of crimes are found in and talked about in Title 21 of Oklahoma law, called statutes, section 13.1. Obviously, 85% of crimes are going to be the more violent variety of crimes, such the murder, rape, robbery, et cetera.
So for example, if you plead guilty to an 85% crime, let’s say it’s a robbery case and you get 10 years in prison, you are not going to be eligible for parole until you have served 85% of that sentence. So a person who pleads guilty to a 10-year sentence, wouldn’t be eligible for parole, to be considered for parole, after serving eight and a half years.
So that’s an 85% crime. You would not be eligible for early release via any earned credits from the Department of Corrections. So that’s why those offenses are very serious because the time served is so much different than other nonviolent or non 85% crimes in Oklahoma, drastically different.
